The Advanced Energy Management Alliance (AEMA) supports the recent U.S. Circuit Court decision (South Carolina Public Service Authority, et al, v FERC, U.S. Court of Appeals for the District of Columbia Circuit, No. 12-1232) to uphold the Federal Energy Regulatory Commission’s Order 1000, requiring regional transmission planning that would lower costs for consumers. While the organization continues to challenge the court decision on FERC Order 745 (U.S. Court of Appeals for the District of Columbia Circuit, No. 11-1486), AEMA was pleased that the U.S. Circuit Court unanimously upheld FERC Order 1000. This rule requires regional planning for alternatives to transmission; demand response becomes a key enabler in looking at more distributed solutions to transmission.
“We believe the continued implementation of Order 1000 will give states and regions additional flexibility, reducing overall system costs and helping consumers save money, “ stated Katherine Hamilton, Executive Director of AEMA. “We think this decision shows an interpretation of the Federal Power Act by the U.S. Circuit Court that should bolster the appeal for Order 745.”
